Terms of Use

1.  Acceptance of Terms

By registering on, accessing, or using the Doctor Bhargava Doctor Portal (the 'Portal'), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not access or use the Portal.
These Terms constitute a binding legal agreement between you ('Doctor', 'User', 'You') and Doctor Bhargava Phytolab Private Limited ('Company', 'We', 'Us', 'Our'), a company incorporated under the laws of India.

2.  Eligibility & Verification

The Portal is exclusively available to qualified and registered homeopathic medical practitioners. By registering, you represent and warrant that:
•    You hold a valid degree in homeopathy (BHMS, MD (Hom), DHMS, or equivalent recognised qualification).
•    You are registered with the relevant State or National Medical Council of India.
•    You are currently practising as a homeopathic doctor at a registered clinic or medical institution.
•    All information you provide during registration is accurate, complete, and up to date.

Access to the Portal's catalogue, ordering, and reward features is conditional on successful verification by our telecalling team. Until verification is complete, you may only view the homepage and registration/login pages.
The Company reserves the right to reject, suspend, or terminate any account where eligibility requirements are not met or where fraudulent information is provided.

3.  Account Registration & Security

Upon successful verification, you will be issued a unique User ID (format: DB-XXXXX) and a one-time password delivered via call and WhatsApp. You are responsible for:
•    Changing your one-time password immediately upon first login.
•    Maintaining the confidentiality of your login credentials.
•    All activity that occurs under your account.
•    Notifying us immediately at d2d@bhargavaphytolab.com if you suspect unauthorised access.

Each account is personal and non-transferable. You may not share your credentials or allow any other person to use your account.

4.  Permitted Use of the Portal

You may use the Portal solely for the purpose of:
•    Browsing and ordering Doctor Bhargava Phytolab medicines for your registered medical practice.
•    Accessing clinical resources, homeopathy research updates, and product knowledge content.
•    Managing your order history, delivery tracking, and rewards wallet.

You must not:
•    Use the Portal for commercial resale, redistribution, or supply to third parties outside your direct medical practice.
•    Attempt to access, scrape, or copy any part of the Portal's catalogue, pricing, or content by automated means.
•    Misrepresent your professional identity or credentials at any point.
•    
•    Interfere with or attempt to disrupt the security or functionality of the Portal.

5.  Orders, Pricing & Discounts

5.1  All orders placed through the Portal are subject to product availability and confirmation by the Company.
5.2  Doctor-exclusive pricing and discounts displayed on the Portal are applicable solely to verified Portal accounts and may not be combined with any other promotional offers unless explicitly stated.
5.3  Discounts vary by product and are subject to change without prior notice. Current pricing at the time of order placement will apply.
5.4  A minimum order value of Rs. 2,000 (Indian Rupees Two Thousand) applies to all orders placed through the Portal.
5.5  All prices displayed are inclusive of applicable taxes unless otherwise stated.
5.6  The Company reserves the right to cancel any order where pricing errors, stock unavailability, or fraudulent activity is detected. You will be notified and any payment received will be refunded promptly.

6.  Payment Terms

6.1  Cash on Delivery (COD): For your first three orders, COD is the default payment mode. Payment is collected at the time of delivery at your registered clinic or delivery address.
6.2  Prepaid: From your fourth order onwards, you are encouraged to switch to prepaid payment. Prepaid orders are processed faster and qualify for additional wallet credits.
6.3  Wallet Credits: Cashback earned through the rewards programme may be applied as a partial or full payment against future orders, subject to the Rewards Policy in Clause 8.
6.4  The Portal accepts payments in Indian Rupees (INR) and select international currencies via supported payment gateways. Currency conversion charges, if any, will be borne by the ordering party.

7.  Delivery & Fulfilment

7.1  Orders are dispatched from our Bhiwadi warehouse via third-party aggregator logistics partners.
7.2  Delivery timeframes vary depending on the delivery location, product availability, and logistics partner coverage. Estimated timelines will be communicated at the time of order confirmation.
7.3  Delivery is available to registered clinic addresses and other addresses within India serviceable by our logistics partners.
7.4  The Company is not liable for delays caused by events outside its reasonable control, including weather, natural disasters, public holidays, or logistics partner disruptions.
7.5  You must inspect the package at the time of delivery. Claims for damaged, incorrect, or missing items must be raised within 48 hours of delivery by contacting d2d@bhargavaphytolab.com or our helpline.

8.  Rewards & Cashback Policy

8.1  The Doctor Bhargava Rewards Programme ('Rewards') is available to all verified Portal account holders.
8.2  Cashback is credited to your Doctor Bhargava Wallet automatically following successful delivery and payment confirmation.
8.3  Reward tiers are as follows:
•    Orders 1–3: COD only. No cashback on COD orders unless expressly notified.
•    Order 4 onwards (Prepaid): Rs. 500 wallet credit on your first prepaid order of Rs. 5,000 or more.
•    Monthly spend of Rs. 5,000 or more: Tier 1 rewards unlocked.
•    Monthly spend of Rs. 10,000 or more: Tier 2 rewards unlocked.

8.4  Wallet credits have no cash value and cannot be transferred, withdrawn, or redeemed for cash.
8.5  Wallet credits expire 12 months from the date of credit unless otherwise communicated.
8.6  The Company reserves the right to modify, suspend, or discontinue the Rewards Programme at any time with reasonable notice.

9.  Returns & Refunds

9.1  Returns are accepted where products are delivered in a damaged condition, are incorrect, or are nearing expiry within 30 days of delivery.
9.2  Return requests must be raised within 48 hours of delivery with photographic evidence where applicable.
9.3  For accepted returns, the Company will arrange pickup from your registered delivery address. You are not required to independently courier or dispatch the product.
9.4  Products that have been opened, partially used, or stored incorrectly are not eligible for return.
9.5  Refunds for prepaid orders will be credited to the original payment method or to the Doctor Bhargava Wallet at the Company's discretion.

10.  Intellectual Property

All content on the Portal, including but not limited to product descriptions, images, clinical content, logos, trademarks, and software, is the exclusive property of Doctor Bhargava Phytolab Private Limited or its licensors. You may not reproduce, distribute, or commercially exploit any content from the Portal without prior written consent.

11.  Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for:
•    Any indirect, incidental, or consequential loss arising from use of the Portal or products ordered through it.
•    Clinical outcomes arising from your use of products ordered through the Portal. Products are prescribed and dispensed at your professional discretion as a qualified practitioner.
•    The Company's total aggregate liability to you shall not exceed the value of your most recent order placed through the Portal.

12.  Termination & Suspension

The Company may suspend or terminate your Portal access immediately and without prior notice if:
•    You breach any provision of these Terms.
•    Your medical registration or qualification is found to be invalid or revoked.
•    Fraudulent, abusive, or unlawful activity is detected on your account.
•    You have not placed any order or logged in for a continuous period of 12 months.

Upon termination, any unused wallet credits are forfeited. Outstanding orders will be fulfilled or refunded as appropriate.

13.  Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
Before initiating formal legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days.

14.  Amendments

The Company reserves the right to modify these Terms at any time. Material changes will be communicated via the Portal or WhatsApp notification to your registered number. Your continued use of the Portal following notification constitutes acceptance of the revised Terms.
